Welcome to KidShelf! These Terms of Service ("Terms") govern your use of the KidShelf mobile application ("App") and related services. By downloading, installing, or using KidShelf, you agree to these Terms.

1. Acceptance of Terms

By accessing or using KidShelf, you confirm that:

• You are at least 18 years old, or you are using the app with parental/guardian consent
• If you are a parent or guardian, you consent to your child's use of the app
• You agree to be bound by these Terms and our Privacy Policy

2. Description of Service

KidShelf is an educational mobile application designed to help children learn to read through:

• Interactive storybooks with speech recognition
• Real-time feedback on reading accuracy
• Speech pattern analysis and practice exercises
• Progress tracking and gamification features
• Vocabulary building tools

3. User Accounts and Profiles

No Account Required

KidShelf does not require user registration or account creation. All data is stored locally on your device.

Child Profiles

You may create profiles for your children within the app. These profiles:

• Are stored only on your device
• Are not transmitted to our servers
• Can be deleted at any time through the app settings
• Will be permanently deleted if you uninstall the app

4. Permitted Use

You may use KidShelf for:

• Personal, non-commercial educational purposes
• Helping children learn to read
• Tracking reading progress for your children
• Educational use in home or classroom settings

5. Prohibited Use

You may NOT:

• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works from the App
• Distribute, license, or sell the App or any part thereof
• Use the App in any way that violates applicable laws
• Attempt to circumvent any security features
• Use the App to collect data about other users
• Use the App for any commercial purpose without authorization

6. Content and Intellectual Property

App Content

The KidShelf application, including its design, code, graphics, and original content, is owned by KidShelf and protected by intellectual property laws.

Story Content

Stories available in the App may include:

• Original Content: Stories created by or for KidShelf
• Public Domain Content: Classic stories from sources like Project Gutenberg
• Licensed Content: Stories used with permission from rights holders

User-Generated Content

Any data you create within the App (profiles, progress data, bookmarks) remains on your device and is not transmitted to us.

7. Speech Recognition Technology

On-Device Processing

KidShelf uses proprietary on-device speech recognition technology. By using the speech recognition features, you acknowledge that:

• Audio is processed in real-time on your device
• Audio is never recorded or stored
• Audio is never transmitted to any server
• Speech recognition accuracy may vary based on device capabilities, background noise, and speech clarity

Optional Native Speech

If you choose to use your device's native speech recognition (optional setting), audio processing may be subject to Apple's or Google's terms and privacy policies.

8. Educational Disclaimer

KidShelf is designed as a supplementary educational tool. You acknowledge that:

• The App is not a substitute for professional reading instruction, tutoring, or special education services
• Speech pattern analysis is for informational purposes and is not a medical or professional diagnosis
• If you have concerns about your child's reading or speech development, consult qualified professionals
• Progress tracking reflects in-app performance and may not correlate directly to standardized assessments

9. Disclaimer of Warranties

KIDSHELF IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy of speech recognition
• Warranties regarding educational outcomes

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIDSHELF AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of data, profits, or goodwill
• Any damages arising from your use or inability to use the App
• Any damages related to educational outcomes or reading development

Our total liability shall not exceed the amount you paid for the App (if any) in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless KidShelf, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

12. Children's Safety

KidShelf is designed for children and includes the following safety measures:

• No social features or communication with strangers
• No user-generated content sharing
• No advertising or in-app purchases directed at children
• No collection of personal information
• Parent/guardian controls for app settings

13. Updates and Changes

App Updates

We may release updates to improve functionality, fix bugs, or add features. Some updates may be required for continued use of certain features.

Terms Updates

We may modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date. Continued use after changes constitutes acceptance of the new Terms.

14. Termination

You may stop using KidShelf at any time by uninstalling the App. We reserve the right to terminate or suspend access to the App for violations of these Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which KidShelf operates, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

1. Good faith negotiation between the parties
2. If negotiation fails, binding arbitration in accordance with applicable arbitration rules

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and KidShelf regarding your use of the App.
